Terms & Conditions

These Terms & Conditions ("Terms") govern your booking of and participation in any photography session offered by Pro Art Photographers ("we," "us," or "our"). Please read them carefully. By booking a session or using our website, you agree to these Terms.

1. Our Services

We provide professional photography services — including flying dress, wedding, couple, family, and portrait sessions — in Cancun, the Riviera Maya, and surrounding destinations. The specific deliverables, duration, and pricing of your session are those agreed with you at the time of booking.

2. Bookings & Reservations

You can request a session through our website form, WhatsApp, email, or social media. A booking is only confirmed once we have agreed on the date, time, location, and package, and you have paid any deposit we request. We recommend booking in advance, as availability is limited, especially during peak season.

3. Payments & Deposits

To secure your date we may require a deposit, with the remaining balance due on or before the day of the session unless otherwise agreed. Prices are quoted in the currency stated at the time of booking. Your reservation is not guaranteed until the deposit has been received.

4. Rescheduling & Weather

Many of our sessions take place outdoors and depend on weather, tides, and daylight. If conditions are unsafe or unsuitable, we will work with you to reschedule to the next available date at no extra cost. Rescheduling requested by you is subject to availability and should be communicated as early as possible.

5. Cancellations & Refunds

If you need to cancel, please notify us as soon as possible. Deposits are generally non-refundable because they reserve time and resources for you, but they may be applied to a rescheduled session at our discretion. Any specific cancellation terms agreed at the time of booking will prevail.

6. Your Responsibilities

  • Arrive on time and at the agreed meeting point; sessions begin and end as scheduled.
  • Follow the photographer's safety guidance at all times, particularly near the water, on rocks, or at heights during flying dress shoots.
  • Ensure that any minors in your group are supervised by a parent or guardian.
  • Treat the equipment, location, and our team with care and respect.

You take part in each session voluntarily and at your own risk. We are not responsible for personal injury or loss of belongings resulting from failure to follow safety instructions.

7. Photo Delivery

After your session we carefully select and professionally edit your images, then deliver them through an online gallery or download link within the timeframe communicated to you. The number of edited images and delivery time depend on the package you booked. Unedited or raw files are not included unless expressly agreed.

8. Image Rights & Intellectual Property

We retain the copyright to all photographs we create. Upon full payment, we grant you a personal, non-commercial license to use and share your images — for example, to print them or post them on social media. Reselling the images or using them commercially without our written permission is not permitted.

9. Model Release & Publicity

Unless you tell us otherwise, we may use selected images from your session in our portfolio, on our website, and on social media, as described in our Privacy Policy. You may opt out of this use at any time by letting us know.

10. Limitation of Liability

We deliver our services with professional care. In the unlikely event of equipment failure, illness, or circumstances beyond our control (force majeure) that prevent a session from taking place, our liability is limited to rescheduling the session or refunding amounts paid for the affected session. We are not liable for indirect or consequential losses.

11. Third-Party Locations & Permits

Some sessions take place at resorts, beaches, or venues that have their own rules, access requirements, or fees. You are responsible for any access or permit costs charged by such third parties unless we have agreed to include them in your package.

12. Governing Law

These Terms are governed by the laws of Mexico and the State of Quintana Roo. Any dispute relating to our services will be subject to the competent courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. The version in force is the one published on this page, with the "Last updated" date shown above.
